Copyright Access and Use Policy

The Cal Poly Pomona University Library aims to make our collection materials available for digital use in the following situations:

  • They are in the public domain;
  • The rights are owned by Cal Poly Pomona;
  • Cal Poly Pomona has permission to make them accessible;
  • Cal Poly Pomona makes them accessible in accordance with the principles of fair use;
  • There are no known restrictions on use;
  • We were not able to confirm that they are subject to copyright and are unable to discern any substantial risk of copyright infringement, privacy concerns, or other objections to disseminating them.

Works within our digital collections are exclusively made available for educational purposes, which may include research or instruction, unless otherwise indicated in the item’s rights statements. Literary rights, including copyright for published works held by the creator(s) or their heirs, or other third parties may apply. All rights are reserved unless otherwise indicated by the copyright owner(s).

The University Library does not claim to control the reproduction rights for all materials or images in its collections. If the California State University system or Cal Poly Pomona does not clearly hold the copyright to an item, the University Library cannot grant or deny permission to use that material.

In obtaining a reproduction from the University Library, you assume all responsibility for determining whether any permissions relating to copyright, privacy, publicity, trademark, or any other rights are necessary for your intended use, and for obtaining all required permissions. Written permission from the copyright holders and/or other rights holders is required for publication, distribution, or other use of protected items beyond that allowed by fair use.

Citation Policy

If you choose to use material from our digital collections, you must properly acknowledge the University Library as the source of that material. Citations for materials found within the University Library’s Digital Collections should include the image title, date, collection name, institutional department (University Library Digital Collections), and URL.

Example, in Chicago:

California State Polytechnic University, Pomona. Graduate Bulletin 1971-1972. Pomona, CA: 1971. California State Polytechnic University, Pomona University Library Digital Collections. https://cpp.access.preservica.com/uncategorized/IO_47c54d43-0f54-4963-ac6e-ef101d17d925/. Accessed on August 5, 2022.

Privacy Policy

Digital collections hosted by the Cal Poly Pomona University Library are intended to provide accurate and complete representations of archival materials in order to advance public knowledge.

Prior to placing materials online, the University Library takes intentional steps to identify and remediate sensitive information that could threaten the privacy and security of individuals, organizations, or other entities represented in the collection(s).

However, as we are committed to preserving the authenticity and integrity of the scholarly and historical record, we are unable to correct errors or inaccuracies present in original items; redact digital content or indices; or otherwise remove access to materials except in cases where there are legal concerns (for example, the presence of HIPAA or FERPA protected information), significant risks to privacy (for example, the presence of personally identifiable information), or evidence of a clear and imminent threat to personal safety and well-being.

Should any item in our digital collection inadvertently expose sensitive or private information, we invite users to submit formal takedown requests. That full policy can be read below.

Takedown Policy

The Cal Poly Pomona University Library adheres to all known copyright and rights of privacy, publicity, or trademark for the materials within our Digital Collections.

If you own copyright to any materials present in our Digital Collections and feel you have not been properly identified or that material is being shared without permission, we ask that you immediately contact the University Library to help us update our records and online holdings.

Specific requests for or questions regarding content removal should be directed to:

Please include the following information with your request:

  • The name and URL of the item or items to be removed;
  • The reason for the removal request;
  • Explanation of any claims to rights for the material, including a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner; and
  • Your contact information (phone number, email address, mailing address).

University Library staff, faculty, and other appropriate members of the campus community, will review the request for just cause.

Upon determination of just cause, the item or items in question will be removed from public view until the request is resolved. After the review process is complete, the University Library will promptly communicate the campus decision and resolution to you.
